FDA Pathway Supports Long-Term Stability, Diversity of Safe and Nutritious Infant Formula Supply in the U.S.

Moment, theU.S. Food and Drug Administration published guidance that will help give a pathway for child formulas operating under enforcement discretion in theU.S. to remain on the request. This will help insure theU.S. continues diversifying its child formula request and make families less susceptible to shocks in the child formula request.

Specifically, the FDA is continuing, under certain conditions, to exercise enforcement discretion relating to the importation and trade in domestic commerce of certain child formula products as part of its trouble to give stable, longer- term access to safe and nutritional child formula across the country. The FDA is communicating directly with, and has made available to manufacturers, the way to take to continue selling certain formulas under enforcement discretion while they work to meet allU.S. nonsupervisory conditions. In May 2022, the FDA blazoned increased flexibilities for the importation of child formula products to address the temporary force deficit. The FDA has issued 16 enforcement discretion letters to eight companies across nine countries, which has helped to ease the deficit, replenish store shelves and diversify the force of child formula in theU.S. As of September 2022, this work has redounded in the import, or planned import, of safe and nutritional child formula, which the companies estimate to be about 403 million 8- ounce bottles(18.9 million barrels). Enforcement discretion for these products was set to expireNov. 14, 2022; still, under certain conditions outlined in the guidance, the new guidance extends that date toJan. 6, 2023, or longer.
Manufacturers presently selling their products in theU.S. under enforcement discretion should shoot a letter to the FDA byDec. 5, 2022, outlining their intent to pursue completion of all nonsupervisory conditions. Upon damage, the agency intends to estimate the request to determine whether to extend the period of enforcement discretion and issue a new letter of enforcement discretion byJan. 6, 2023. For manufacturers that admit a new letter of enforcement discretion, the FDA doesn’t intend to expostulate to the continued marketing of covered child formulas in theU.S. through October 2025 while the manufacturers take way to achieve compliance with all conditions that apply to their products.
